AI Governance for Regulated Industries
Regulated industries face a unique tension with AI adoption. On one side, AI tools offer enormous productivity gains — faster document review, automated summarization, intelligent drafting, and real-time research. On the other side, the data these industries handle is precisely the kind of data that must never reach an uncontrolled third-party service. Healthcare has HIPAA. Finance has SOC 2 and PCI-DSS. Legal has attorney-client privilege. Government has FedRAMP and CMMC.

The Regulatory Landscape for AI
No major regulation explicitly bans AI tool usage — yet. What regulations do require is that you protect the data in your care regardless of which tools you use to process it. HIPAA does not mention ChatGPT, but it requires that Protected Health Information is safeguarded whenever it is transmitted to a third party. PCI-DSS does not reference Claude, but it mandates that cardholder data is protected in transit and at rest. SOC 2 does not name any AI tool, but it requires controls around data access, processing, and monitoring.
This means that every time an employee pastes regulated data into an AI tool, the same rules apply as if they emailed it to an external party or uploaded it to an unapproved cloud service. The fact that it happens in a browser chat window does not create an exception.
Healthcare: HIPAA and PHI Protection
Healthcare organizations handle Protected Health Information across every workflow — clinical documentation, billing, patient communication, and research. AI tools are transformative for each of these areas, but PHI must never reach an AI provider that has not signed a Business Associate Agreement.
Practical governance for healthcare means three things. First, classify which AI tools are approved for which data types. Enterprise tiers of some AI providers offer BAAs, but free and standard tiers do not. Second, deploy DLP scanning that detects the 18 HIPAA identifiers — patient names, medical record numbers, dates of service, Social Security numbers, and more — before they leave the browser. Third, maintain an audit trail of every AI interaction and DLP event for compliance reviews and incident investigation.

When an auditor asks how you prevent cardholder data from reaching AI tools, you need a technical control and an audit log — not just a policy document.
Legal: Privilege and Confidentiality
Law firms and legal departments face a distinct concern: attorney-client privilege. Information shared with an AI tool may not remain privileged, especially if the AI provider's terms of service allow using input data for model improvement. A single inadvertent disclosure could waive privilege for an entire matter.
Legal AI governance requires strict tool vetting (only providers that contractually commit to not training on input data), DLP rules that detect case numbers, client names, opposing party information, and settlement figures, and clear policies about which legal tasks can and cannot involve AI assistance. Many firms also restrict AI usage to specific approved workflows — like legal research and first-draft generation — while prohibiting it for client-facing communications.
Government: FedRAMP and CMMC
Government agencies and their contractors operate under some of the strictest data handling requirements. FedRAMP governs cloud service authorization, and CMMC (Cybersecurity Maturity Model Certification) establishes cybersecurity standards for defense contractors. Both frameworks require documented controls around data processing, access management, and audit logging.
Government AI governance starts with tool authorization — only AI tools deployed in FedRAMP-authorized environments may process government data. DLP scanning must detect Controlled Unclassified Information markers, government identifiers, and classified data patterns. Every interaction must be logged, and those logs must be retained according to agency-specific records management policies.
Building a Cross-Industry Governance Framework
Despite different regulations, the governance framework is structurally similar across industries. Every regulated organization needs five components:
- Approved tool policy — Which AI tools are authorized, for which data types, and under what conditions. Review and update this quarterly as AI providers change their offerings.
- Data classification — Clear rules about what data categories can and cannot be shared with AI tools. Map these to your existing data classification scheme.
- Technical enforcement — DLP scanning that runs in real time, before data reaches the AI tool. Policy documents alone do not prevent data leaks; technical controls do.
- Audit logging — A complete record of AI interactions, DLP events, and policy violations. This is not optional for regulated industries — auditors will ask for it.
- Training and enablement — Educate employees on the governance framework and provide them with approved prompts, templates, and workflows that make compliance the path of least resistance.
The organizations that succeed with AI governance are the ones that treat it as enablement, not restriction. The alternative — banning AI tools entirely — just pushes usage underground where you have zero visibility and zero control.
